| 1. This Contest is conducted by AETN All Asia Networks Pte. Ltd. (“AAAN”) and shall be for the period from 15 July 2009 to 31 August 2009. |
| 2. This Contest is open to all registered subscribers of HISTORY™ with valid accounts with AAAN’s authorized platforms in the following countries, namely Singapore, Hong Kong, Taiwan, Thailand, Philippines, Indonesia, Papua New Guinea, Cambodia, Brunei and Vietnam (“Registered Subscriber”). AAAN has the absolute discretion at any time to determine the eligibility of any participant to the Contest and reserves the right to disqualify any participant without any obligation to grant any reason whatsoever. |
| 3. By entering into the Contest, all participants, Winners and their companions agree to be bound by the Terms and Conditions stated herein. AAAN reserves the right to amend these Terms and Conditions from time to time without prior notice, and all participants, Winners and their companions shall be deemed to agree to abide by such amendments. |
| 4. The employees of AAAN and their immediate family members are not entitled to participate in this Contest. |
| 5. One lucky draw chance will be allocated to each Registered Subscriber who enters into the Contest on the HISTORY website www.historyasia.com. |
| 6. The lucky draw will be conducted in Singapore on 11 September 2009 and the Winner will be selected randomly. |
| 7. AAAN reserves the right to draw reserve winner(s) to substitute any winner subsequently found to be disqualified. AAAN reserves the sole and final discretion to determine the winner of the Contest and no correspondence or discussion concerning the result will be entertained to non-winners. |
| 8. The winner of the Contest (“Winner”) will be entitled to either an Australia or a Japan Package Tour for two persons worth total value equivalent to SGD5,000 (“Prize”). The Prize will be dispatched in travel vouchers from a designated travel agency from the Winner’s country of residence. If the value of the selected travel package exceeds the voucher face value, the difference shall be borne by the Winner. Package tour booking, once finalized cannot be changed. |
| 9. The Winner of the Contest will be notified via email or phone by end of September 2009. The Prize must be collected within TWO (2) weeks from the notification date, failing which the Prize will be forfeited. AAAN shall not be responsible for any unclaimed or forfeited Prize. Any winner whose prize has been forfeited shall not be entitled to any payment or compensation notwithstanding non-receipt of notification. |
| 10. If Prize notification is undeliverable via email or phone, or if the Winner’s contact details in the records are incorrect or incomplete, the Prize will be deemed to be forfeited by the Winner and AAAN reserves the right to select an alternate Winner at the sole discretion of AAAN. In the event that an alternate Winner is selected, AAAN will not arrange another prize or any compensation for the first Winner. |
| 11. AAAN shall not be responsible for the arrangement and availability of flight and accommodation associated with the Prize and for any delays in flights or hotel check-in which may affect Prize itinerary. |
| 12. Winner and his/her companion must hold valid passports and all required visas required for travel to Australia or Japan (as applicable) prior to departure from his/her country of residence. |
| 13. Expenses not specifically stated above in the Prize, including the payment of all applicable taxes, fees, surcharge, airport taxes, fuel surcharge, insurance, visa costs and arrangements, spending money, passport cost and any and all ancillary costs (including compliance with any health or other Government requirements) arising from the acceptance or use of the Prize shall be the sole responsibility of the Winner. |
| 14. The Prize is strictly non-transferable and not exchangeable for cash. |
| 15. AAAN reserves the sole discretion and right to cancel, postpone, modify, change or delay the Prize for any reason whatsoever without prior notice. In the event that the Prize should become unavailable, AAAN reserves the right to withdraw or substitute a prize of equal value without prior notice. |
| 16. AAAN and all other sponsors and associated entities are not liable for any damage, loss, accident, injury and/or inconvenience arising in any way that may be suffered by, or caused to Winner and his/her properties in conjunction with the fulfillment of Prize nor for any changes in dates/times, or cancellations which may prevent Winner from taking the original Prize offered or any part of Prize. |
| 17. It is a condition precedent for participation in this Contest that the Winner and his/her companion consent to: (a) the public disclosure of their names, identification/passport numbers and photographs for publicity or commercial purposes; (b) participate in the publicity and promotional activities of AAAN in relation to the Contest; and (c) use of any information or data provided by such winner for any future marketing efforts of AAAN, without further notice or compensation. Unless otherwise indicated, all information supplied by participants, Winners and their companions shall be deemed as non-confidential and shall not bear any obligations of confidentiality. |
| 18. In the event of any inconsistency between these Terms and Conditions and any brochures, marketing or promotional materials relating to this Contest, these Terms and Conditions shall prevail. |
| 19. A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Right of Third Parties) Act (Cap. 53B) to enforce these Terms and Conditions. |
| 20. Each participant is fully responsible for ensuring that his/her participation in the Contest is lawful in accordance with the laws of the country of which he or she is a citizen and/or resides, and/or happens to be at the time of entering into the Contest. Neither AAAN nor the sponsors nor associated entities shall be taken to make any representations, express or implied, as to the lawfulness of any participant's participation. |
| 21. These Terms and Conditions shall be governed by the laws of Singapore, and all participants who participate in the Contest shall be deemed to have agreed to submit to the exclusive jurisdiction of the Singapore Courts. |
